Junta’s 2008 Constitution as NULL and VOID

Global Action for Burma (GAB) today calls for United Nations Security Council (UNSC) to declare the unilaterally adopted Burmese junta's 2008 sham constitution, which is designed to legitimize military rule permanently in Burma, as NULL and VOID.

The very junta who is ruling the country held the election in 1990 in which Aung San Suu Kyi’s party, National League for Democracy (NLD) won landslide victory but until now the results are still yet to be honored. Instead of honoring the elections of 1990 results, junta drafted the constitution unilaterally which legitimize the military rule in Burma and now again planning to hold sham election in 2010.

Aung San Suu Kyi and her party the National League for Democracy (NLD), the unanimous victors of the 1990 election, clearly stated their position in the “Shwe- Gone-Dine” Declaration that need to place in order to have true national reconciliation i.e. to Review 2008 Constitution and to recognize 1990 election result.

Junta has been ignoring the voices people of Burma and going ahead unilaterally to entrench military dictatorship in Burma permanently. The junta’s planned 2010 election is only a charade designed to legitimize the military dictatorship within Burma.

Before we could possible address the junta’s proposed 2010 election we must address the validity of the recently adapted constitution. Drafted by the junta, this document is far from credible or constitutional. Free, fair and all inclusive is not what this document represents.

The International Community should be aware of the hopelessly irreconcilable contents of the constitution that was adopted in 2008. The referendum was ushered into existence under questionable conditions including extortion and rigged ballots.

We would like to draw particular attention on these points:

1. The Junta gave itself amnesty from the crimes against humanity it has perpetrated throughout Burma during their reign of terror.

2. The Military regime systematically took 25% of the parliamentary seats. The military commander in chief was also given absolute authority to dissolve the parliament at any time effectively neutralizing the voice of the people.

Giving the military junta 25% of the parliamentary seats, unbridled authoritarian control and a self serving amnesty for the crimes against humanity were truly not the will of the Burmese people. Legitimizing the criminal regime was also not the will of the people and this is incomprehensible and totally unacceptable to the Burmese people.

The essence of the 2008 Constitution is to guarantee impunity indefinitely and the 2010 election will implement it. Therefore, we call for United Nations Security Council (UNSC) to declare the unilaterally adopted Burmese junta's 2008 sham constitution, which is designed to legitimize military rule permanently in Burma, as NULL and VOID.

Notes to Editor:

It is reasonable to request the nullification of the 2008 Constitution by the UN Security Council. Precedence for such a move can be found in UNSC Resolution 554 regarding South Africa’s 1983 apartheid-entrenching constitution1.

We Need Your Support and please forward this very important message to all your friends who concern Burma

Dear Friends and Leaders,

I hope this letter finds you well. This is Myo Thein, the Director at the Burma Democratic Concern (BDC) which is the global campaigning and lobbying organisation to restore democracy, human rights and rule of law in Burma where everyone can enjoy the freedom of speech, press, assembly and rule of law that emphasizes the protection of individual rights.

I am writing this letter to inform you that we need your support since Burma crisis is in its pivotal state.

I am sending the Burma Constitutional Conference ( Discussion in Burmese Language Part 1-6) and interviews of the democratic leaders in English and Burmese.

You may aware that ruling junta of Burma is planning to hold the sham election in 2010 with sham 2008 constitution which is adopted and drafted unilaterally and designed to legitimised military rule in Burma.

Apology for non-Burmese speaking friends but I would be very much appreciated if you could promote and share this information with your friends.

We would like to explain why we boycott junta's 2010 election.

It is because the essence of the 2008 Constitution is to guarantee impunity indefinitely and the 2010 election will implement it.

So long as the 2008 Constitution continues to exist, elections in 2010 and the following period will not be adopted as legitimate elections.

We do not need another election in 2010 in the first place since the last democratic free and fair election was held in 1990 by the very junta who is ruling Burma today, in which Aung San Suu Kyi led National League for Democracy (NLD) won landslide victory.

“If this country is to achieve genuine democracy, the result of the elections of 1990 must be recognized.” Aung San Suu Kyi.

Aung San Suu Kyi should be the Prime Minister of Burma according to the 1990 election result.

Instead of honouring the 1990 election result, junta put Aung San Suu Kyi under house arrest until now and political suppressing intensified.

The 2008 Constitution must be revised by cancelling
(a) The impunity provision , and
(b) Other provisions which solidify the rule of the military dictatorship.

(or)

Burmese people will call for United Nations Security Council (UNSC) to declare Burma’s 2008 Constitution as null and void.

Aung San Suu Kyi once said that “It is even appropriate or justified for the international community carries out the responsibility to intervene in the internal affairs of another country whose power are creating hell for the population. The international community as a whole should recognise that it has got responsibilities. It can’t ignore grave injustices that are going on within the borders of any particular country.”

It is reasonable to request the nullification of the 2008 Constitution by the UN Security Council. Precedence for such a move can be found in UNSC Resolution 554 regarding South Africa’s 1983 apartheid-entrenching constitution.

Please do share this letter with your friends to let the world know that military government in Burma is systematically instigating the military rule in Burma forever.

Dear Sirs and Madams,

Just as much as you appreciate and value your own personal freedoms, we the oppressed peoples of Burma have the same values, and although we have been denied, for many decades, such freedoms, we seek your help as we struggle to regain this freedom.

In 1962 our country, in its early years of freedom, was hijacked by a military dictatorship that eradicated all civil institutions and embarked on a process that has produced devastating consequences for our country. Its leader, General Ne Win, imposed his own brand of ideology on the nation, where military officials replaced almost all civilian workers in the nation�s administrative institutions. Civil society also came under military control and the country degenerated into a terrifying tyranny.

In 1974, the Burma Socialist Program Party (BSPP) drafted their constitution which enabled the dictatorship to establish a pseudo-civilian government, and General Ne Win transformed himself from a military leader into both the President and the Chairman of the only party in the country. His continued misgovernance of the country, including the demonetarization of the currency, produced dire results for the people, who were systematically impoverished by his reckless mismanagement.

Burma, under Ne Win�s mismanagement, degenerated into abject poverty, and the majority of the population suffered greatly. By 1987, Burma had become one the poorest nations in the world, and was given Least Developed Country status by the United Nations. This degeneration culminated in the mass demonstration of 1988, whereby the people protested for the freedoms so long denied them by the dictatorship. In response to the protests, the BSPP disbanded and Ne Win stepped down as President and Chairman.

However, far from relinquishing power, the military clique reemerged in essentially the same form, with Ne Win's henchmen and pro-togas as its leaders. Under the leadership of Saw Maung, the military staged a coup and promised multiparty elections to quell the unrest and mass demonstrations. However, political parties were denied the right to campaign publicly, and had to organize indoors. Nonetheless, when the 1990 elections were held, the National League for Democracy (NLD) won 82% of the vote, winning 383 out of the all seats. Saw Maung acknowledged that the results were fair and genuine, and promised that the military would return to the barracks. This was simply a maneuver on the part of the military, and Saw Maung later states that first there must be a constitution, and the military will not hand over power until it is drafted. The military then proceeded to hand pick their own representatives for a conference to draft the new constitution, and outnumbered the legitimate representatives elected in the 1990 elections, they also demanded that over 20% of the government was to be made up of military personnel. Furthermore, they demanded that the military hold important positions within the government, including Defense, and that the positions of President and Prime Minister had to be approved by the military. This resulted in the NLD, and other elected representatives, boycotting the drafting of the constitution.

There was then over ten years of stalling by State Law and Order Restoration Council (SLORC), and then the State Peace and Development Council (SPDC), the various names the military junta gave itself, and they have conspired to eliminate Daw Aung San Suu Kyi, as well as other prominent elected leaders. There have been more than sufficient indicators that strongly suggest that this was ordered from the top military leaders of the junta. Failing to eradicate the movement for democracy, they then hatched a 7-point plan, or so-called �Road Map to Disciplined Democracy� in 2003. This was another blatant maneuver by a regime that was unwilling to relinquish their power. This was simply a rehashing of Ne Win�s 1974 BSPP dictated constitution.

In 2007, student leaders of 1988 asked the military rulers to consider the plight of the people who faced unrealistic increases in fuel costs imposed by the dictatorship. Their response was to arrest the student leaders, who were then given long jail sentences. In the same period, Buddhist monks approached the military leadership and reminded them of their duty to the people � the dictatorship responded with brutal force. The military shot and arrested monks, and entered many monasteries and destroyed them. Many were killed, with estimates suggesting over 300 monk and civilian victims.

In May, 2008, although foreign meteorological centers warned the military of an impending high force cyclone, the SPDC downplayed the intensity predicted by these sources. The devastating result of this deliberate withholding of information was that over 100,000 people were killed, and over a million people lost their homes and livelihood. Amidst this catastrophe, 8 days after the disaster, on the 10th of May, the SPDC held a referendum for its bogus constitution, and claimed a 93% yes vote. Later in the year, political prisoners were given extended jail sentences, and their lawyers were arrested and given long jail sentences from 20-65 years as well. This was in order to silence all possible political opposition by the democratic movement and its leaders.

The military rulers of Burma now plan to implement the 7th Stage of their so-called �Road Map to Disciplined Democracy� � the 2010 general elections. The abovementioned facts and track record of the military show that they are determined to maintain power, at the expense of the wellbeing of the nation. In 1948 Burma had gained independence and was known as the �Rice bowl of Asia�, and its currency had real value. It was known as a fast developing nation�. However, after 1962, Burma�s position rapidly plummeted, and it eventually reached Least Developed Country status, and had one of the worst human rights abuses records in the world. The military leaders of today are in reality clones spawned by Ne Win � they were the coup leaders of 1988, and none of the promises given by them have ever been kept. Their denial of foreign aid after Cyclone Nargis illustrates that they are not, and have never been, concerned about the welfare of the people. This present day attempt to fool the international community into believing that they will adopt a democratic process is merely a facade. It is no more than a carbon copy of the 1974 constitution which was designed to keep the military in power. Thus, the planned so-called return to civil rule will only further enslave the nation, and will extinguish all genuine democratic opposition to their rule.

In this critical year of 2009, we ask delegates of the international community at the United Nations General Assembly�s annual meeting and the European Union not to recognize this bogus and fraudulent election designed by the military. We ask all to join forces and to use the instruments of the United Nations to bring about a genuine change and true democracy for the people of Burma. We thank you in anticipation for the work you are about to undertake.

ထို႔အတူ ဇန္နဝါရီလ ၂၁ႏွင့္ ေဖေဖၚဝါရီ ၉ရက္တို႔တြင္ အေမရိကန္ သမၼတ အိုဘားမားထံ အိတ္ဖြင့္ေပးစာ ႏွစ္ေစာင္ကို၄င္း ၊ မတ္လ ၇ရက္ေန႔တြင္ ၂၀၁၀ ေရြးေကာက္ပြဲကို ကန္႔ကြက္ရန္ အြန္လိုင္း လက္မွတ္ေရးထိုးေတာင္းဆိုမည့္ ကမ္ပိန္း တခုကို လည္း ေဆာင္ရြက္ခဲ့ပါသည္။ (ထိုကမ္းပိန္းမွာ သတ္မွတ္ထားေသာ လက္မွတ္အေရ အတြက္ မရရွိသည့္ အတြက္ ေအာင္ျဖင္မႈ မရရွိခဲ့ပါ။ ထိုသို႔ ျဖစ္ရျခင္းမွာ အျခားေသာ ႏိုင္ငံေရး ဦးေဆာင္ အဖြဲႀကီးမ်ား၏ ၂၀၁၀ ႏွင့္ ပါတ္သက္ေသာ သေဘာထားမ်ား ရွင္းလင္းစြာ ထုတ္ျပန္ ခဲ့ျခင္း မရွိေသးျခင္းေၾကာင့္လည္းေကာင္း၊ အျခားေသာ ကမ္ပိန္းႀကီးမ်ားႏွင့္ ဥပမာ ႏိုင္ငံေရး အက်ဥ္းသားအားလံုး လြတ္ျမာက္ေရး ေတာင္းဆိုမႈ ကမ္ပိန္း တို႔ႏွင့္ တိုက္ဆိုင္ ေန ခဲ့ျခင္း တို႔ေၾကာင့္ ျဖစ္ပါသည္။)

ေဒၚေအာင္ဆန္းစုၾကည္ေနအိမ္သို႔ ဂၽြန္ယက္ေတာ ဝင္ေရာက္သည့္ ကိစၥႏွင့္ ပါတ္သက္ ၍ တရားစြဲဆိုေနစဥ္က မဲေဆာက္ ေဒသရွိ ႏိုင္ငံေရး အဖြဲ႕ အစည္း၊ အလုပ္သမား အဖြဲ႕ အစည္း တခ်ဳိ႔ႏွင့္ ပူးေပါင္းကာ Joint Action Committee ကိုဖြဲ႕စည္းကာ ေမလ ၂၄ ရက္ ေန႔က မဲေဆာက္ျမန္မာ ခ်စ္ၾကည္ေရး တံတားေအာက္တြင္ ဆႏၵျပပြဲ တႀကိမ္၊ ေမလ ၂၇ရက္က မဲေဆာက္ၿမိဳ႕ UNHCR ရံုးေရွ႕တြင္တႀကိမ္ ဆႏၵျပ၍ မစၥတာ ဘန္ကီမြန္းထံ အိတ္ဖြင့္ေပးစာ တေစာင္ ေပးအပ္ခဲ့ၿပီး၊ ဇြန္လ ၄ရက္ေန႔က ဘာသာေပါင္းစံု ဆုေတာင္းပြဲ တၾကိမ္ႏွင့္ ဇြန္လ ၇ရက္ေန႔က မဲေဆာက္ ခ်စ္ၾကည္ေရး တံတားေရွ႕တြင္ တႀကိမ္ ဆႏၵျပခဲ့ၿပီး ထိုင္းဝန္ႀကီးခ်ဳပ္ အဘိဆစ္ကို အိတ္ဖြင့္ ေပးစာ တေစာင္ေပးပို႔ခဲ့ပါသည္။ ထိုဆႏၵျပပြဲ မ်ားသည္ မဲေဆာက္ၿမိဳ႕တြင္ ႏွစ္ႏွစ္ဆယ္ အတြင္း အဖမ္းအဆီး အေႏွာင့္အယွက္ မရွိ ပဲ ေအာင္ျမင္ စြာ ျပဳလုပ္ႏိုင္ခဲ့ေသာ ဆႏၵျပပြဲမ်ားျဖစ္ပါသည္။

ေဒၚေအာင္ဆန္းစုၾကည္ ေမြးေန႔ ဆုေတာင္းပြဲႏွင့္ ၈၈၈၈ ၂၁ႏွစ္ျပည့္ ဘာသာေပါင္းစံု ဆုေတာင္းပြဲ တို႔ကိုလည္း ေဆာင္ရြက္ ႏိုင္ခဲ့ၿပီး တျခားေသာ အဖြဲ႕ အစည္းမ်ား၏ လႈပ္ ရွား ေဆာင္ရြက္မႈမ်ားတြင္လည္း တတ္စြမ္းသမွ် ပူးေပါင္း ပါဝင္ ေဆာင္ရြက္ခဲ့ပါသည္။

ယခုအခါတြင္ ၂၀၀၉ စုစည္းလႈပ္ရွားမႈေကာ္မတီ အေနျဖင့္ ျပည္တြင္း ျပည္ပ အဖြဲ႕ေပါင္း ၁၀၀ေက်ာ္ျဖင့္ ဖြဲ႕စည္းထားေသာ GAB ေခၚ Global Action for Burma အဖြဲ႕ ဝင္ အဖြဲ႕ တခု အေနျဖင့္ ဆက္လက္ ပူးေပါင္းေဆာင္ရြက္ေနပါသည္။

ေက်းဇူးစကား ႏႈတ္ခြန္းဆက္စကား

လာမည့္ ဒီဇင္ဘာလ ၁ရက္ေန႔ဆိုလွ်င္ ၂၀၀၉ စုစည္းလႈပ္ရွားမႈ ေကာ္မတီ၏ သက္တမ္း တႏွစ္ျပည့္ေျမာက္ခဲ့ၿပီ ျဖစ္သလို အလုပ္အမႈေဆာင္ အဖြဲ႔၏ ဆံုးျဖတ္ခ်က္ျဖင့္ ထုတ္ေဝခဲ့ေသာ အမွန္တရား ဂ်ာနယ္သည္လည္း ယခုလတြင္ ၁၀ အုပ္ေျမာက္အျဖစ္ ထုတ္ေဝ၍ ယခုႏွစ္ သက္တမ္း အတြက္ အဆံုးသတ္ ေတာ့မည္ ျဖစ္သည္။

ေနာက္ထပ္ထုတ္ေဝရန္ မထုတ္ေဝရန္ကိုမူ လာမည့္ အလုပ္အမႈေဆာင္ ကြန္ဖရင့္မွ ဆံုးျဖတ္ မည္ ျဖစ္ရာ အယ္ဒီတာ အဖြဲ႕မွ ယခုႏွစ္အတြက္ ေက်းဇူးတင္ ႏူတ္ဆက္စကားကို ေျပာလို ပါသည္။

ဖန္ေငြဟူ၍ မရွိပဲ ယံုၾကည္ခ်က္တူသူမ်ား၏ စုစည္းမႈျဖင့္ အမွန္တရားကို ေဖၚျပရန္ ျပည္သူ လူထုမ်ားကို အသိပညာေပးရန္ႏွင့္ ေဖ်ာ္ေျဖတင္ဆက္မႈေပးရန္ အမွန္တရားဂ်ာနယ္ကို ထုတ္ေဝခဲ့ၾက ရာတြင္ ေငြေၾကးအခက္အခဲ၊ နည္းပညာအခက္ အခဲတို႔သာမက အမ်ဳိဳးမ်ိဳးေသာ အခက္ အခဲေပါင္း မ်ားစြာကို ရင္ဆိုင္ခဲ့ ၾကရသည္။

ထိုအခက္အခဲမ်ားကို ႀကံ႕ႀကံ႕ခံ လက္တြဲရင္ဆိုင္ခဲ့ၾကေသာ စုစည္းလႈပ္ရွားမႈ ေကာ္မတီ အဖြဲ႕ဝင္ မ်ားကိုလည္း အယ္ဒီတာ အဖြဲ႕မွ ေက်းဇူး အထူးတင္ရွိပါေၾကာင္း မွတ္တမ္း တင္လိုပါသည္။

အထူးသျဖင့္ ကြန္ျပဴတာ ဖိုင္ထုတ္ေပးလုိက္ၿပီးသည့္ အခ်ိန္မွ စာအုပ္ ျဖစ္ေျမာက္သည္အထိ မအိပ္မေန ကူညီေဆာင္ရြက္ေပးခဲ့ေသာ ဦးဇနကႏွင့္ ABMA အဖြဲသားမ်ားကို၄င္း၊ ပံ႕ပိုးထုတ္ေဝ ေပးခဲ့ သည့္ ABMA အဖြဲ႕ႀကီးကို၄င္း၊ စိတ္ဓါတ္အား ေငြအား လူအားျဖင့္ တတ္စြမ္းသမွ် ကူညီ အားေပး ခဲ့ သည့္ ကိုမန္းမ်ိဳးျမင့္၊ ဤဂ်ာနယ္၏ အေျခခံ ဒီဇိုင္းကို ေရးဆြဲေပးခဲ့ေသာ ကိုစံႏွင့္ အၿမဲ ဝိုင္းဝန္း အားေပး၍ စာနယ္ဇင္းအေတြ႕အႀကံဳျဖင့္ အႀကံျပဳ ကူညီေပးသူ ဆရာေနမ်ိဳးေအး (ရဲေခါင္ မဲေမာင္) တို႔အား အထူးေက်းဇူးတင္ရွိပါေၾကာင္း မွတ္တမ္းတင္ လိုပါသည္။

ထို႔အတူ ဤဂ်ာနယ္တြင္ ဝိုင္းဝန္းပါဝင္ ေရးသားေပးၾကသည့္ စာေရးသူမ်ား၊ ခြင့္ျပဳခ်က္ ရယူႏိုင္ ခဲ့ျခင္း မရွိပဲ ပင္တိုင္နီးပါး ကူးယူသံုးစြဲခဲ့သည့္ ဧရာဝတီ၏ ပင္တိုင္ သေရာ္စာေဆာင္းပါးရွင္ ဆရာ ရန္ကုန္သား တာေတႏွင့္ အျခားေသာ စာေရးဆရာ ကဗ်ာဆရာႀကီးမ်ားကိုလည္း အထူးေက်းဇူး တင္ရွိ ရပါေၾကာင္း ေျပာလိုပါသည္။
